Terms of Service

1. LICENSE AND USE OF SERVICE

1.1 OPD Manager grants you a limited, non-exclusive, non-transferable license to use the Service solely for your professional medical practice management.

1.2 You agree not to sublicense, sell, reverse engineer, or attempt to extract the source code of the Service.

1.3 The software is a tool for management and does not provide medical advice or diagnosis. Professional medical decisions remain your sole responsibility.

2. SUBSCRIPTION AND PAYMENTS

2.1 Payment Model: We operate on a manual payment and activation model for 1-year, 3-year, and 5-year plans. No automated recurring billing is currently implemented.

2.2 Free Trial: A 1-month free trial is provided to all users. It is your responsibility to evaluate the Service during this period.

2.3 Refund Policy: As a trial is provided, all manual subscription payments are strictly non-refundable once the plan is activated.

3. DATA AND PRIVACY

3.1 Data Fiduciary: You are the Data Fiduciary for your patients' records. You represent that you have obtained necessary consents from patients to store their records in this Service.

3.2 Data Segregation: Each organization's data is stored in a completely separate database. We implement encryption so that clinical patient names remain private and unreadable by our system administrators.

3.3 Deletion: Clinical data for expired accounts will be permanently deleted from our servers 90 days after subscription expiry.

4. SERVICE AVAILABILITY AND BACKUPS

4.1 We strive for high availability; however, the Service may be interrupted for maintenance or technical issues. We perform weekly backups for data recovery purposes.

4.2 We use official Meta WhatsApp APIs for reminders. Service delivery via WhatsApp is subject to Meta's platform availability and policies.

5. LIMITATION OF LIABILITY

5.1 To the maximum extent permitted by law, OPD Manager shall not be liable for any indirect, incidental, or consequential damages, including loss of clinical data, arising from the use of the Service.

5.2 Governing Law: These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Rajkot, Gujarat.
